Accused in Caseyville DUI death was released from jail day before crash

The man accused of driving under the influence of drugs and striking and killing a Caseyville pedestrian on Nov. 27 was released from the St. Clair County jail the day before the crash, records show.

Shaun Schmierbach, 32, of Belleville was arrested on a warrant Nov. 20 for violating five conditions of his probation from a felony theft conviction in 2012, a person at the St. Clair County Circuit Clerk’s office confirmed.  It was the second time Schmierbach was convicted of violating probation on the charge.

Schmierbach pled guilty on Nov. 26 to the latest charge and was sentenced to six days in jail. He was credited with time served and released. Sentencing in violation probation cases is at the discretion of the judge, an official said.  Chief Judge John Baricevic issued the order, records show.

Attempts to reach St. Clair County State’s Attorney Brendan Kelly for comment were unsuccessful.

Jamal Rhodes, 29, of Caseyville was walking along Illinois Route 157 on Nov. 27 when a van driven by Schmierbach struck and killed him, police said.

Schmierbach also pled guilty to violating his probation in April 2013. On April 25, he was sentenced to six days in jail, credited with time served and put on intensive probation, which required him to report to parole officials more frequently.

On Oct. 21, Schmierbach was arrested by the Illinois State Police for driving on a suspended license. The first court appearance for the offense, originally scheduled for Nov. 22, was rescheduled to Jan. 7, 2014. The court date was changed

Schmierbach has been charged with 25 traffic violations in St. Clair County since 1997, including two charges of driving on a suspended license. Among the 44 charges against him in St. Clair county since 1997, seven involve drugs or alcohol. The charges filed Saturday of eckless homicide and driving under the influence of drugs are the second and third felony charge against Schmierbach.
