Katelyn R. Stapleton, 26, of 100 block of the W. Main was charged with involuntary manslaughter, a felony. Birch died of a single gunshot wound to the head in the early morning hours of Feb. 23.

The incident occurred in Birch’s home in the 600 block of Arrowhead Drive, Collinsville. Police were called to the residence around 1:30 a.m. Birch was transported to Anderson Hospital, where he was pronounced dead five days before of his 24th birthday.

There were three other people in the home with the former Collinsville High School football player at the time of the incident, Assistant Police Chief Tom Coppotelli said on Feb. 23.

The case was presented to a grand jury, rather than charges pressed by the Madison County State’s Attorney’s Office, because it was a complicated case, Lt. Todd Link, of the Collinsville Police Department said.

“Both departments thought it was best to present it to a grand jury,” Link said.

According to charges filed with the Madison County State’s Attorney’s office, Stapleton is accused of firing a gun in a reckless manner, an act likely to cause death or great bodily harm to an individual.

Stapleton is being held in the Madison County Jail on $100,000 bond. Her next scheduled court date is May 30, at 9 a.m. at the Madison County Courthouse.

If convicted, she could serve between 2-5 years on prison.
